(“XSE”), together with their respective parents, subsidiaries, divisions, affiliated entities, assumed business names (DBAs), brands, websites, applications, platforms, services, successors, and assigns (collectively, the “Company,” “Companies,” “we,” “our,” or “us“) respect the privacy of Users and are committed to protecting Personal Information.

This Privacy Policy applies solely to residents of the United States, as our services are only available in the U.S.

  • Any affiliated website, platform, application, storefront, donation portal, service, or communication channel operated by or on behalf of the Company

This Policy applies regardless of which specific Company entity or brand you interact with unless a separate privacy policy expressly supersedes this Policy for a specific service.

“Affiliated Entity” means any entity operating under common ownership, common control, shared management, coordinated operation, contractual integration, or participation within the TorqueForm ecosystem, including entities owned or operated by related individuals or family members where such entities utilize, participate in, integrate with, or receive services through Platform Services.

Affiliation shall not, by itself, create joint liability.

Each Affiliated Entity remains solely responsible for its own obligations unless expressly agreed otherwise in writing.

Depending upon transaction structure, the Company may facilitate payments on behalf of Vendors.

However, except where expressly stated otherwise:

  • Vendors remain sellers of record;

  • Vendors remain responsible for products and services;

  • Vendors remain responsible for fulfillment, quality, legality, safety, and customer obligations associated with their offerings.

The Company’s involvement in payment facilitation does not, by itself, transfer responsibility for underlying goods or services to the Company.

 

10. NONPROFIT OPERATIONS

Certain Platform Services may be operated by XSE.

XSE operates as an independent nonprofit organization recognized under Section 501(c)(3) of the Internal Revenue Code.

While XSE may utilize infrastructure, systems, or services provided by affiliated entities, XSE remains a separate legal entity and no part of its net earnings shall inure to the benefit of private individuals or shareholders.

 

11. DATA RETENTION

Information may be retained:

  • As long as necessary to provide services

  • To comply with law

  • To resolve disputes

  • To enforce agreements

  • To maintain business records

Anonymized information may be retained indefinitely.

 

12. DATA SECURITY

The Company implements commercially reasonable administrative, technical, and physical safeguards designed to protect information.

However:

  • No method of transmission is completely secure;

  • No storage system is completely secure;

  • Unauthorized access cannot be entirely prevented.

Users acknowledge these inherent risks.

  • Objection to processing

The Company reserves the right to verify identity prior to responding.

Platform Services are not directed to children under thirteen (13) years of age.

By using Platform Services, Users consent to such transfers.

 

17. NO GUARANTEE OF SECURITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ANY GUARANTEE THAT INFORMATION WILL REMAIN FREE FROM:

  • ALTERATION

  • DESTRUCTION

USERS ASSUME THE RISKS INHERENT IN ELECTRONIC COMMUNICATIONS AND INTERNET-BASED SERVICES.

 

18. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

  • THIRD-PARTY ACTIONS;

  • ACTS OF VENDORS;

  • ACTS OF SERVICE PROVIDERS;

  • CYBERATTACKS;

  • INTERNET FAILURES;

  • EVENTS BEYOND ITS REASONABLE CONTROL.

19. CHANGES TO THIS POLICY

The Company reserves the right to modify this Policy at any time.

Changes become effective upon posting.

Continued use of Platform Services after any changes constitutes acceptance of revised terms.

The Company website may contain links to third-party websites. We are not responsible for the privacy practices or content of these external sites. We encourage users to review the privacy policies of any linked websites before sharing personal information.

 

21. Governing Law

This Policy shall be governed by the laws of the state of Montana, without regard to its conflict of laws principles.
