Affiliation shall not, by itself, create joint liability.
Each Affiliated Entity remains solely responsible for its own obligations unless expressly agreed otherwise in writing.

9. MARKETPLACE ROLE CLARIFICATION
The Platform functions primarily as a technology and marketplace infrastructure provider.
The Company may facilitate:

Payment processing
Depending upon transaction structure, the Company may facilitate payments on behalf of Vendors.
However, except where expressly stated otherwise:
Vendors remain sellers of record;
Vendors remain responsible for products and services;
Vendors remain responsible for fulfillment, quality, legality, safety, and customer obligations associated with their offerings.
The Company’s involvement in payment facilitation does not, by itself, transfer responsibility for underlying goods or services to the Company.
10. NONPROFIT OPERATIONS
Certain Platform Services may be operated by XSE.
XSE operates as an independent nonprofit organization recognized under Section 501(c)(3) of the Internal Revenue Code.
While XSE may utilize infrastructure, systems, or services provided by affiliated entities, XSE remains a separate legal entity and no part of its net earnings shall inure to the benefit of private individuals or shareholders.

USERS ASSUME THE RISKS INHERENT IN ELECTRONIC COMMUNICATIONS AND INTERNET-BASED SERVICES.
18. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:
THIRD-PARTY ACTIONS;
ACTS OF VENDORS;
ACTS OF SERVICE PROVIDERS;
CYBERATTACKS;
INTERNET FAILURES;
EVENTS BEYOND ITS REASONABLE CONTROL.
19. CHANGES TO THIS POLICY
The Company reserves the right to modify this Policy at any time.
Changes become effective upon posting.
Continued use of Platform Services after any changes constitutes acceptance of revised terms.

This Policy shall be governed by the laws of the state of Montana, without regard to its conflict of laws principles.
